Rental Terms & Conditions – A16695 Control Pendant
By proceeding with the refundable deposit rental checkout, you acknowledge and agree to the following terms and conditions set forth by Cyber-Tech, Inc.
Rental service is only available within the Continental USA.
1. Purpose
This rental program provides a temporary replacement control pendant while your original unit is being assessed and optionally repaired by Cyber-Tech, Inc.
2. Payment & Refund Policy
A refundable deposit of $800 is required at checkout.
Shipping from Cyber-Tech, Inc. to you is calculated and charged during checkout.
The deposit will be partially refunded, subject to the following deductions:
Repair costs (only if you explicitly approve the repair),
All logistics costs, including initial shipping and return shipping,
Damage or replacement charges, if applicable.
3. Logistics & Repair Workflow
The rental pendant will be shipped to you with a prepaid return label for sending your damaged unit back to Cyber-Tech, Inc.
Upon receipt of your damaged unit, our team will contact you within 3 business days to provide:
A detailed repair estimate, and
Estimated logistics charges for return shipping.
If you approve the repair:
We will proceed with the repair.
The repair cost and logistics charges will be deducted from your deposit.
Once the rental pendant is returned in good condition, the remaining balance of the deposit will be refunded.
4. If You Decline the Repair
If you choose not to proceed with the repair:
You may request the return of your damaged unit by notifying us in writing within 5 business days of receiving the repair estimate.
Your deposit will be refunded, minus the shipping/logistics costs already incurred.
5. Rental Return Policy
Rental pendants must be returned within 10 calendar days of your repaired unit being delivered.
All returned units will be inspected upon receipt.
If the rental unit is:
Damaged beyond normal wear**, or
Not returned at all,
**Additional deductions may apply up to the full deposit amount. In severe cases, the entire deposit may be forfeited.
Note: "Normal wear" includes cosmetic surface scuffs and expected signs of use during careful handling. It does not include cracks, dents, internal damage, water exposure, or cable cuts.
6. Packaging & Return Shipping Responsibility
Customers are responsible for securely packaging all equipment being returned. We strongly recommend using the original box and protective packaging materials provided with the rental unit.
If the original packaging is damaged, lost, or unusable, you agree to:
Use a box of equal or greater strength and protection, and
Ensure the pendant is properly cushioned and immobilized to prevent damage in transit.
If equipment is returned improperly packaged and arrives damaged, repair or replacement costs will be deducted from your deposit.
Return Shipping Label Responsibility:
A prepaid return shipping label is included with your rental shipment. If you lose or damage this label, you are solely responsible for:Purchasing your own return shipping using a trackable and insured carrier, and
Submitting the tracking number to Cyber-Tech, Inc. immediately upon shipment.
Failure to provide a valid tracking number may result in processing delays or additional charges if the unit is lost or delayed in transit.
Important: Customers will not be held responsible for shipping carrier mishandling if proper packaging guidelines were followed.
7. Ownership
The rental pendant remains the exclusive property of Cyber-Tech, Inc. at all times. Failure to return the unit within the required timeframe may result in forfeiture of the deposit and may be subject to additional billing.
8. Termination & Non-Return
If the rental pendant is not returned within 30 days of your repaired unit being delivered — and no communication is received — Cyber-Tech, Inc. reserves the right to:
Deem the rental lost or unreturned,
Retain the full deposit, and
Pursue collection or legal action, if necessary.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Cyber-Tech, Inc. shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to: Lost profits, Business interruption, Business delays, Lost business opportunities, or Any similar damages, arising out of or related to the rental, use, non-use, repair, or return of the control pendant, even if Cyber-Tech, Inc. has been advised of the possibility of such damages.
In all cases, Cyber-Tech, Inc.’s total liability is strictly limited to the refundable portion of the deposit, after applicable deductions for logistics, repair costs (if approved), and any damage or replacement charges as outlined in these Terms & Conditions.
10. Customer Responsibility for Testing & Compatibility
The customer agrees to thoroughly inspect, test, and verify the functionality of the rental pendant prior to connecting it to their own equipment.
It is the customer’s sole responsibility to:
Determine the compatibility of the rental pendant with their equipment,
Confirm that all connections, inputs, and usage parameters meet the required specifications, and
Ensure that using the pendant will not interfere with or damage their systems.
By using the rental pendant, the customer assumes all risk and liability related to its use with their equipment. Cyber-Tech, Inc. shall not be held responsible for any equipment damage, operational failures, or incidental losses resulting from improper use, misconnection, incompatibility, or failure to test the pendant beforehand.
11. Changes to Terms & Conditions
Cyber-Tech, Inc. reserves the right to revise, update, or modify these Rental Terms & Conditions at any time without prior notice.
The version in effect at the time of your checkout will govern your rental.
